Abus administratifs

Ce sont des usages excessifs ou injustes qui empêchent le bon fonctionnement des administrations. Ils peuvent se traduire par des lenteurs administratives volontaires au bénéfice des détenteurs de pouvoir dans le secteur public ou privé ainsi que dans certaines organisations.

Les avantages découlant de ces abus peuvent revêtir la forme de dons, offres, promesses, présents, sommes d’argent, faveurs, distinctions, récompenses, emplois…Exemples : Abus de pouvoir…

L’Excès de Pouvoir

Se matérialise par chaque ordre d’utilisation du pouvoir public par un juge ou un fonctionnaire public ou toute demande d’intervention contre l'application d’une loi ou pour la collecte de l'impôt fixé par la loi ou contre la mise en œuvre des ordonnances ou des décisions judiciaires ou des ordonnances émanant d'une autorité légitime. Toute décision administrative rendue par une autorité non compétente ou portant un vice de forme ou un dérèglement de pouvoir ou une absence de fondement ou une violation de la loi constitue un Excès de pouvoir.

L’Abus d’Influence

• Toute demande ou acceptation d’une offre ou d’une promesse, ou demande ou réception d’un don ou d’un cadeau ou de tout autre avantage, afin de permettre à une personne ou d'essayer de lui permettre, d’obtenir un Ordre, un rang ou une récompense ou honoraire, un statut, une fonction ou un service ou tout autre avantage accordé par l'autorité publique ou une affaire ou un projet ou tout bénéfice résultant de l'accord conclu avec l'autorité publique ou avec le ministère placé sous sa supervision,

• Toute obtention d’une décision en faveur d'une telle autorité ou administration, en prenant avantage de cette influence réelle ou supposée.
