L’avenant ne peut être conclu que dans la limite des délais contractuels d'exécution.
Néanmoins cette dernière disposition ne s'applique pas dans les cas suivants :
Lorsque l'avenant est sans incidence financière et porte sur l'introduction et ou la modification d'une ou plusieurs clauses contractuelles autres que celles aux délais d'exécution.
Lorsque des raisons exceptionnelles et imprévisibles indépendantes de la volonté des deux parties entraînent la rupture substantielle de l'équilibre économique du marché ou le déplacement du délai contractuel initial.
Lorsque, exceptionnellement l'avenant à pour objet de clôturer définitivement le marché.
